Wis. Grave Robbers' Sex Assault Charges Dropped
(AP) Madison, Wis. Three men who dug up a young woman's corpse to have sex with it after seeing her obituary photo cannot be charged with attempted sexual assault because Wisconsin has no law against necrophilia, an appeals court ruled Thursday.
A judge was correct to dismiss the charges against twin brothers Nicholas and Alexander Grunke and Dustin Radke, all 21, because lawmakers never intended to criminalize sex with a corpse, the District 4 Court of Appeals said in a 3-0 ruling.

True, and I'm not arguing that what they did shouldn't carry any punishment. I'm saying that since it turns out it wasn't illegal, at least according to that judge, and since we don't allow double jeopardy or ex post facto laws, that's rightfully the end of it, in terms of criminality. Individuals can decide for themselves to shun those "sick fucks" as the psychopaths that they are, or even for the desecrated corpse's family to bring an action for intentional infliction of emotional distress, or conceivably, property damage. But, like anyone else who's found not guilty, their case file ought to be sealed and they should be able to go about their lives unmolested.

Point is, they were vindicated. The justice system shouldn't be in the business of watching certain types of people "just in case," because we all know where that leads, don't we?
