The FEC decided McCain isn't on the hook for dropping out of the matching funds program. As it happens, I think that was correct, but consider the deliberations they went through.
Seriously, the type of Supreme Court justice McCain would appoint would insist on the first possible interpretive method and McCain would be stuck with crippling (in this case) spending limits.
