Thomas called 'an embarrassment'

December 6, 2004 – Clarence Thomas was criticized by incoming Senate Minority Leader Harry M. Reid (D-Nev.) who, during an appearance on “Meet the Press” Sunday, referred to the Supreme Court justice as “an embarrassment.”

Reid’s message focused on the need for Democrats to resist the conservative agenda. “We have to work toward the middle,” he said. “We have a situation where, during the past four years . . . we have approved 207 federal judges and turned down 10. The president should be happy with what he’s gotten.”

Although William Rehnquist is still serving as chief justice, his illness has raised questions about whether he will remain on the Court. Reid said he would not be in favor of appointing Thomas as chief justice, saying, “I think that he has been an embarrassment to the Supreme Court. I think that his opinions are poorly written. I just don’t think he’s done a good job as a Supreme Court Justice.”

Thomas, a Republican and one of the most conservative members of the Court, is the second African American to serve on the U.S. Supreme Court. He was appointed by former President George H.W. Bush in 1991 following the retirement of Thurgood Marshall.



Were Reid’s comments out of line to call a Black man “an embarrassment” or does Clarence Thomas deserve the criticism?

Why would it be out of line for Reid to call Thomas an embarrassment to the Supreme Court? On the record, Thomas is hardly a pillar of jurisprudential excellence.

Frankly, I would be hard pressed to take offence if Reid had stated that Thomas is an embarrassment to the race.

Yeah. Pitching stare decisis is a start. It's like at the root of legal reasoning.

Add to that his total lack of qualification and yes, weak reasoning. But I'm merely hyperrational, not a lawyer.
