A Lawrenceville man was freed Tuesday after spending 41 days in jail on murder charges.
Alan Craig Smith, one of two men charged in the Feb. 19 slaying of 85-year-old Hubert Massey, was released after a store's security camera proved he was shopping when the slaying occurred.
Smith walked out of jail late Tuesday and was embraced by his parents, Sheila and Ken Smith, and his girlfriend, Jessica Holcomb.
"I knew I was innocent," Smith said. "I just waited for them to come get me."
Smith's court-appointed attorney, Lyle Porter, said Smith was released because a surveillance tape from a Lilburn Wal-Mart showed Smith and Holcomb in the store's parking lot and in the store from 1:22 to 2:02 a.m. the morning of the shooting. Another tape showed the couple at a Duluth Circle K from about 2:12 until 2:26 a.m.
Massey was killed between 1:45 and 1:55 a.m. during a home invasion, according to Porter, who said the time was based on when Massey's wife called 911.
